WINstorm Presents Inc (“WINstorm”, “WPI”, “we”, “us”) values privacy and respects yours when using WINstorm. This Privacy Policy applies to, and governs, your use of WINstorm software, services, and websites (collectively “technology” or “product”), as a visitor or a registered user (a “User”). We may amend this policy from time to time to account for developments under the law, or for any other commercially reasonable reason. Any amendment will only become effective upon notification to you (by email or by posting on our Site) and, if you do not want to agree to any such amendment, you should stop using the Site and the Product and contact us to cancel your account. By using WINstorm technology, you consent to the collection, use, disclosure, and other uses of personal information pursuant to this Privacy Policy. Please check the policy periodically for changes. At the start of the policy, we indicate the date of an update to the Privacy Policy. The continued use of the WINstorm websites following the posting of changes to this Privacy Policy will mean you accept those changes. If there is a material change in our data collection, use or disclosure policies for any of our services, WINstorm will post this within the site as a method of in forming our users of the change(s).
- ‘Personal information’ shall have the meaning attributed to such term within the provisions of Part 1 of the Personal Information Protection and Electronic Documents Act, S.C. 2000, c.5 (“PIPEDA”) (“Personal Information”). Each party shall comply with the provisions of PIPEDA and with their own) privacy policy and procedures in terms of all Personal Information which is collected, used, or disclosed by either party pursuant to this (WINstorm’s) Privacy Policy.
- Each party shall cease all use of all Personal Information received from the other party pursuant to this Privacy Policy upon any termination or expiry of this Privacy Policy and promptly return same to the other party by a secure means without delay.

1. What Information We Gather and Track?

- Status variables such as if you have verified your email address
- System Logs:
- Login and logout events, including user name, company/client name, IP address, remote host name, date, browser name/version, name of the operating system, screen dimensions, language preference, last login date, origin of login (country, region, city) and other meta data.
- Email send logs including user name, subject line, recipient count, mailing list ID, date, sender name, sender email, send ID, campaign ID
- These logs are collected or generated automatically when using the Service
- Content:
- All content you upload and generate (type, paste, drag and drop) within the product. This includes campaign names, recipient counts, send dates, save dates, email recipients, subject line, email body, website content, page titles, SEO meta data, social media meta data (title, description, image), media assets you upload or add via URL (images, videos, audio, attachments)

- Contact Manager:
- Users may upload, import, add, edit, update and delete contacts in the Contact Manager module of the product.
- Available fields include prefix, first name, last name, email, phone, company, title, country, region, city, address, tags, notes, extra1, extra2, extra3, extra4, extra5, file name/origin, unsubscribe date
- Form Submissions:
- Users can create customized forms that visitors can fill out and submit, which can include user-defined fields and inputs (e.g. short text, long text, radio button, checkbox)

- Viewer Data:
- Engagement with the emails you send and the websites you create is tracked and reported in the Analytics module inside WINstorm.
- This tracking data includes the client ID, campaign ID, campaign name, send ID, page ID, page title, date, duration, email delivery status, links that were clicked, and information about the viewer (IP address, remote host name, country name, region name, city name, contact ID)
2. Why We Collect the Information We Gather and Track?
We use Your Personal data to provide, maintain, debug and improve the Service, including the purpose of monitoring the usage of our Service. WINstorm may also use your Data for the following purposes:
- To manage Your Account: to manage Your registration as a user of the Service. The Personal Data You provide can give You access to different functionalities of the Service that are available to You as a registered user.
- To manage Your requests: To attend and manage Your requests to Us.
- To contact You: To contact You by email, telephone calls, SMS, or other equivalent forms of electronic communication, such as a mobile application's push notifications regarding updates or informative communications related to the functionalities, products or contracted services, including the security updates, when necessary or reasonable for their implementation.
- To measure the performance of your campaigns: So that we can report engagement on Your email and website campaigns.
- To track usage: in order to modify the site according to our customers’ needs.
- To support the features of our product: sending emails requires contact lists, in order to grow your mail list you need opt-ins (form submissions), to automate mail list opt-outs, to be found by web crawlers (to improve SEO), to provide meaningful insights to our users.
- For other purposes: We may use Your information for other purposes, such as data analysis, identifying usage trends, determining the effectiveness of our promotional campaigns and to evaluate and improve our Service, products, services, marketing and your experience.
- For internal training purposes
3. Consent
Unless an exemption applies under applicable privacy laws, your knowledge and consent is required for the collection, use, or disclosure of Personal Information. If you use or register for the Website, request information about services offered by WINstorm, or otherwise provide your Personal Information to WINstorm, you consent to the collection, use, disclosure and management of your Personal Information in accordance with this Privacy Policy. You may
withdraw your consent by writing to the Privacy Officer identified in section 13 of this Privacy
Policy.
4. Data Sharing & Disclosure
We do not sell, or rent your personal information with third parties for their promotional use. We may disclose information to partners who introduced you to WINstorm services to ensure they are properly compensated for their business development efforts. Certain Personal Information that we collect may be shared among employees and contractors under NDA (within WINstorm) solely for the purposes of processing your requests (such as tech support). WINstorm will only disclose your Personal Information for the purpose for which it was collected except with your consent or as permitted by law. We may disclose or report personal information in limited circumstances where we believe in good faith that disclosure is required under the law. For example, we may be required to disclose personal information to cooperate with regulators or law enforcement authorities, to comply with a legal process such as court order, subpoena, search warrant, or law enforcement request.
In the event that the company be bought, it will be the sole responsibility of the purchaser to update the privacy policy and notify all clients of any changes. Legacy personal date will be held in confidence until such changes have been communicated and accepted by existing clients.
5. Data Accuracy & Updating Personally Identifiable Information
WINstorm will keep Personal Information as accurate, complete, and up-to-date as is necessary for the purposes for which it is to be used. If your personally identifiable information changes you may request that WINstorm update the information by sending an email to privacy@winstorm.ca with the subject line “Data Update” and by providing sufficient information in the email body to identify your account along with the desired changes to your personal data being requested. We will do our best to respond to your request to access within 10 business days. 7. Third Party Personally Identifiable Information
WINstorm’s login page has a button to login using Facebook. The first time you click this, you will be asked by Facebook to give WINstorm access to your Name, Email and Profile Picture. This information is only used to facilitate an easier way to log into WINstorm and for no other purpose. We do not send Facebook any of the data we collect on you. We do not send or receive personally identifiable information with any other partners, affiliates, or third parties, unless specifically authorized by you to do so.
8. Data Storage, Safeguards, Breaches & Retention
The information we gather is collected and stored in a manner that we determine is appropriate for the nature of the data that we collect, and the need to fulfill your request. WINstorm protects Personal Information with safeguards appropriate to the sensitivity of the information by maintaining appropriate physical, procedural and technical security with respect to its offices and information storage facilities so as to prevent any loss, misuse, unauthorized access, disclosure, or modification of Personal Information. We treat personal data as assets that must be protected against loss and unauthorized access. We employ information security techniques to appropriately protect confidential information from unauthorized access by users inside and outside WINstorm. Access to customer information is limited to those employees who have a legitimate business need for that information, under NDA. WINstorm keeps the Personal Information that it collects about you strictly confidential. Only authorized personnel have access to this Personal Information. WINstorm cannot guarantee that any Personal Information that you may choose to disclose via the internet will not be intercepted by third parties. WINstorm assumes no responsibility for Personal Information disclosed through the internet, which is intercepted, diverted or otherwise accessed. We may store and process Personal Information in the United States, Canada, or any other country in which we (or any of our agents) maintain facilities. Personal Information will only be retained as long as necessary for the fulfillment of such purposes. In the event of a breach of your personal information or your contact information we will notify you as soon as we become aware of such a breach, and shall follow up with additional information, including what action was taken to limit or correct such a breach. Users are Responsible for Protecting Information and Systems on their Premises such as login credentials. Users concerned about the security of their information in these systems should secure it using appropriate methods such as encryption, multi-factor authentication, etc.
If you create websites or send emails using WINstorm, you should be aware that any personally identifiable information you submit can be read, collected, or used. When you send messages or view content using any form of telecommunication technology, the data is transmitted
between multiple points in order to reach its intended destination. Messages sent via WINstorm should not be used to deliver confidential information. We may review the content of User messages in order to ensure that they comply with our Terms of Service. We may do this manually or we may scan your message content with software to ensure that the content adheres to our requirements. We are not responsible for the personally identifiable information you choose to include in emails sent via WINstorm and websites hosted by WINstorm.
9. Cookies
A cookie is a small file placed on Your Device. A Persistent Cookie remains on Your personal computer or mobile device when You go offline. We use a cookie solely for the purposes of keeping you logged in to WINstorm as a paying user and to remember you when you return so you can skip the login prompt. This cookie is necessary / essential to keep you logged in. Visitors to your user-created websites do not use or require this cookie. You can instruct Your browser to refuse all Cookies or to indicate when a Cookie is being sent. However, if You do not accept Cookies, You will not be able to log in to WINstorm. If you delete this cookie while logged in, You will be automatically logged out. If you delete this cookie between sessions (not logged in), You will be required to log in next time. The cookie we pass to you is anonymous. It does not reveal your personal identity, will not follow you throughout your travels on the web, nor can it capture private data. Rather, this cookie establishes a user session so You can access our services and interact with appropriate content.

WINstorm is responsible for personal information under its control and to this end WINstorm has appointed a privacy officer who is accountable for WINstorm’s compliance with this Privacy Policy and applicable privacy laws. The contact information for the Privacy Officer is outlined in section 13 of this Privacy Policy.
11. Limiting Collection
WINstorm will limit the collection of Personal Information to that which is necessary for the purposes identified by WINstorm in this Privacy Policy or otherwise identified at the time of collection. WINstorm will collect Personal Information by fair and lawful means.
