Updated April 4, 2024
WINstorm Presents Inc (“WPI”, "WINstorm", "we" or "us") retains the right to delete Customer Data, at any time, without any responsibility or liability to the Customer, if Customer’s account is in violation of WINstorm’s Terms of Service, is delinquent, suspended, or terminated for 30 days or more, or if the data is in violation of WINstorm’s Terms of Service, is corrupt, or is no longer supported. Once data has been deleted, it cannot be recovered.
Users of WINstorm Presents Inc (“users”, “customers”, "you") may request that their Personal Data be permanently deleted by sending an email to privacy@winstorm.ca with the subject line “Data Deletion” and providing sufficient information in the email body to identify your account. WINstorm reserves the right to contact you by email, phone or other reasonable methods in order to verify the request and to ensure the correct account is being deleted.
Data deletion will be conducted in accordance with best practices for deletion of sensitive data. For example, WPI will utilize industry-standard tools to securely delete data from its hard drive, including backups, which will write over the data 7 times to ensure it is not recoverable.
Data deletion will be completed within 30 days of receiving a data deletion request, unless, deletion of the requested data, in part or in whole, is in violation with WINstorm’s Terms of Service, WINstorm’s Privacy Policy, an applicable law that requires retention, or when data retention is required by law enforcement such as a subpoena or court order that is related to your use of WINstorm.
We may amend this Agreement from time to time to account for developments under the law, or for any other commercially reasonable reason. Any amendment will only become effective upon notification to you (by email or by posting on our Site) and, if you do not want to agree to any such amendment, you should stop using the Site and the Product and contact us to cancel your account.
By logging in to your WINstorm account, or by accessing WINstorm’s software (the “Product”) by means of any API interface, you accept this Agreement on behalf of yourself and any business or organization you represent (collectively, "you"). Any terms and conditions that may be contained in any acknowledgement, invoice, purchase order or other form you provide are specifically null and void.
